Clarification of legislation on the admission of registration and permit of appeals, reports and other information on crimes and incidents in the Russian law-enforcement bodies "

 

The order of receiving registration and authorization of appeals, reports and other information on crimes and incidents, is set by an art.114-145 of the Russian Federation Code of Criminal Procedure. The investigator, inquiry body, the investigator, the head of the investigating body are obliged to take, check a report on any committed or planned crime, and within the competence to take a decision on it within a period not later than 3 days from the date of receipt of the report.

Obtained during the inspection of reports on crime data can be used as evidence. If, after an initiation of a criminal case the defense or the victim declares a request for production of additional or repeated forensic, such a request should be granted.

The period of inspection of the report on the crime may be extended to 10 days. If the situation requires the production of documentary checks, inspections, forensic examinations, researches, as well as carrying out special investigative actions, this period may be extended up to 30 days with the obligatory indication of the specific factual circumstances giving rise to such extension.

Upon receiving the application, the applicant is issued a document (a card - notification) on the adoption of reports on crime, providing details about the person to accept it, as well as the date and time of its adoption.

Refusal to accept reports on crimes may be appealed to the prosecutor or the court in the manner prescribed by articles 124 and 125 of the Russian Federation Code of Criminal Procedure.

After reviewing the reports on crimes an authorized officer shall take one of the following decisions:

1) initiating criminal proceedings in order.

2) refusal to initiate criminal proceedings;

3) transfer of report in accordance with the jurisdiction.

The applicant shall be informed on the taken decision. In this case the applicant shall be explained his right to appeal the decision and the appeal procedure.

Reception and registration of appeals (reports) on crimes, administrative violations and incidents are carried out around the clock. Terms of permissions  of appeals (reports) on crimes, administrative violations and incidents are governed by federal laws and other normative legal acts of the Russian Federation.
